Terms of Service

These Terms of Service (“Terms”) govern your use of the PetPerps website and services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PetPerps lets you upload a photo of your pet and generate a stylized AI “mugshot,” which you can then customize, download, and share. Physical merchandise may be offered in the future.

2. Eligibility

You must be at least 13 years old to use the Service, and at least 18 to make a purchase. You are responsible for the accuracy of any information you provide.

3. Your content

You retain ownership of photos you upload (“Your Content”). You grant PetPerps a worldwide, non-exclusive, royalty-free license to host, process, and modify Your Content solely to operate and improve the Service and to deliver the products you order. You represent that you have the right to upload Your Content and that it does not violate any third-party rights or applicable law.

4. Acceptable use

You agree not to:

• Upload content depicting humans, nudity, violence, or anything illegal or hateful.
• Upload content you do not own or have permission to use.
• Attempt to reverse-engineer, scrape, overload, or disrupt the Service.
• Use the Service to harass, defame, or violate the rights of others.

We may remove content, refund or cancel orders, and suspend or terminate access for violations at our discretion.

5. Generated content

Outputs generated for you (“Generated Content”) are licensed to you for personal, non-commercial use upon successful payment. Due to the nature of AI generation, identical or substantially similar outputs may be generated for other users; we do not guarantee uniqueness.

6. Orders, pricing, and refunds

• Digital mugshots are delivered electronically. Because they are generated and delivered immediately, digital purchases are non-refundable except where required by law.
• If and when physical products are offered, they will be fulfilled by our print partner, Printful, with shipping times and costs shown at checkout. Defective or damaged physical products may be replaced or refunded at our discretion if you contact us within 30 days of delivery.
• Prices and taxes are shown in U.S. dollars unless otherwise stated.

7. Intellectual property

The Service, including its design, branding, code, and (other than Your Content and Generated Content licensed to you) all materials made available through it, is owned by PetPerps and protected by intellectual property laws.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PETPERPS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM, OR (B) $50.

10. Indemnification

You will indemnify and hold harmless PetPerps from any claim arising out of Your Content, your breach of these Terms, or your misuse of the Service.

11. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the Service at any time.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute will be brought exclusively in the state or federal courts located in Delaware, and you and PetPerps consent to personal jurisdiction there.

13. Changes

We may update these Terms. Material changes will be communicated by updating the “last updated” date above and, where appropriate, by additional notice. Continued use of the Service after changes constitutes acceptance.
